Terms of Service

These Terms of Service (“Terms”) form the agreement between you and MISTRAL SPARK LIMITED, a company registered in the United Kingdom (“Petverse”, “we”, “us”). They cover your use of the Petverse iOS app and the petverseapp.com website (together, the “Service”).

1. Acceptance

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old to use Petverse, and at least 16 if you live in the United Kingdom or the European Economic Area. You must also be legally able to enter into a binding contract under the laws of your country. If you use Petverse on behalf of a household or business, you confirm you have authority to bind them to these Terms.

3. Your account

You are responsible for keeping your sign-in credentials confidential and for any activity on your account. Provide accurate information when signing up and keep it up to date. Tell us promptly at hello@petverseapp.com if you suspect unauthorised access.

4. Acceptable use

You agree not to:

• Abuse, harass, threaten, or impersonate other users.
• Upload illegal, infringing, or harmful content.
• Scrape, mirror, or systematically extract data from the Service.
• Reverse engineer, decompile, or attempt to derive source code, except where law expressly permits.
• Attempt to bypass rate limits, authentication, row-level security, or any other technical protection.
• Use the Service to send spam or unsolicited messages.
• Interfere with or disrupt the Service or the infrastructure running it.

We may suspend or terminate accounts that breach these rules, with or without notice depending on severity.

5. Your content

You own the content you add to Petverse: photos, dog profiles, logs, posts, and voice recordings. You grant us a worldwide, non-exclusive, royalty-free license to host, store, transmit, process, and display your content solely to operate the Service for you and the caregivers you invite. The license ends when you delete the content or your account, except for backups that age out within 30 days.

You warrant that you have the rights to the content you upload and that it does not infringe anyone else's rights or break the law.

6. AI features and not-veterinary-advice

Pet Pal and our other AI features (text chat, voice agent, transcription, read-aloud) provide general information only. They are not veterinary advice, diagnosis, or treatment. Always consult a qualified veterinarian for medical concerns about your pet, and call an emergency vet for urgent symptoms.

AI output can be wrong, incomplete, or out of date. We are not liable for decisions you make based on AI-generated content, and you use it at your own discretion.

7. Subscriptions and in-app purchases

Petverse is currently free to use. If we introduce paid tiers, they will be billed through Apple in-app purchase and governed by Apple's standard subscription terms. You can manage and cancel any subscription in the App Store at any time. Refunds are handled by Apple under their refund policy.

8. Termination

You may delete your account at any time from Settings → Delete account in the app. We may suspend or terminate your access if you breach these Terms, if we are required to by law, or if continuing the Service to you would expose us or other users to harm. Where reasonable we will give you notice and a chance to fix the issue first.

Sections that by their nature should survive termination (content licenses you granted up to that point, disclaimers, limitation of liability, governing law) survive.

9. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted, error-free, secure against every threat, or that any data will never be lost. Nothing in these Terms excludes liability that cannot be excluded under English law (for example, for death or personal injury caused by negligence, or for fraud).

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) £50 if you are on a free tier.

We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, even if we knew such loss was possible. The exclusions above do not apply to liability that cannot be limited under English law.

11. Indemnification

You agree to indemnify and hold harmless Mistral Spark Limited, its directors, employees, and contractors from any claims, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your content, or your misuse of the Service.

12. Changes to these Terms

We may update these Terms from time to time. For material changes we will notify you in-app or by email before they take effect. Continued use of the Service after the change means you accept the updated Terms. If you do not accept them, delete your account.

13. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from or related to these Terms or the Service, except that consumers resident in the EU or other jurisdictions may rely on mandatory rights under their local law.
